Welcome to Jobsey! These Terms and conditions govern your use of the Platform as a Service seeker or Service Provider. By registering, you agree to comply with these terms. Jobsey acts Solely as an intermediary connecting Service Seekers to providers and is not a party to any agreements between them. Jobsey is not liable for disputes arising from transactions.

1. Introduction to Jobsey
Jobsey is an online platform designed to facilitate the connection between clients seeking various services and service providers in Seychelles. The Platform aims to simplify the process of finding reliable services by offering features such as Browse providers, viewing ratings, reviews, and price ranges. Jobsey also assists individuals seeking work or aiming to expand their workload. Jobsey acts solely as an intermediary and is not a party to any agreements between clients and providers.
2. General Terms Applicable to All Users
2.1. Acceptance of Terms
By using the Jobsey Platform, you confirm that you are at least 18 years old and legally capable of entering a binding contract. You agree to comply with all applicable laws and regulations regarding your use of the Platform.
2.2. Platform as a Facilitator
Jobsey acts solely as a facilitator to connect service seekers and service providers. We do not directly provide any of the services listed on the Platform. We are not responsible for the quality, legality, or safety of the services performed, nor for the conduct of any service seekeror service provider.
2.3. User Accounts
To utilize certain features of the Platform, you must register for an account.
You agree to provide accurate, current, and complete information during the registration process and to update such information to maintain its accuracy, currency, and completeness.
You are responsible for maintaining the confidentiality of your account password and are solely responsible for all activities that occur under your account. You agree to notify Jobsey immediately of any unauthorized use of your account.
Jobsey reserves the right to remove or block certain service seekers and service providers who do not adhere to the guidelines of the Platform.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated herein by reference. All user data and interactions will be logged and stored in a database, accessible by administration for monitoring activities and maintaining standards.
2.6. Modifications to Terms
Jobsey reserves the right to modify these Terms at any time. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms. The Platform is designed to be easily improved, and new categories can be added readily, allowing for growth and adaptation.
3. Terms for Customers (Service Seekers)
3.1. Browse and Searching for Services
Service seekers can browse through categories or use the search bar to find services.
Service seekers profiles will display service provider names, profile pictures, mission statements, work samples, ratings, and reviews. Some categories may also include a price range.
3.2. Communication with Service Providers
Once a service seeker identifies a suitable service provider, they can choose to send a message to discuss job details.
Alternatively, Service seekers can use the “get a quote” option to submit job details, with the option to attach pictures or documents.
3.3. Posting a Job
Service seekers can post a job with all relevant details.
Service seekers have two options for pricing when posting a job: “Budget range” (where they specify a range, and providers make offers) or “Make an offer” (where providers bid based on the description).
Service seekers are required to provide full job details, requirements, and attachments if needed. They can also specify dates or time windows for job completion.
3.4. Acceptance of Offers
Service seekers can review offers from service providers and select their preferred provider.
Once both parties agree and accept the project on the Platform, they will be subject to specific terms and conditions.
3.5. Reviews and Ratings
Service seekers can provide reviews and ratings for service providers based on their performance.
Reviews must be factual, non-abusive, and relevant.

4. Terms for Service Providers
4.1 Access to Job Listings
Registered and accepted service providers will have access to a “Job Listings” section where they can search for available jobs posted by clients.
4.2. Bidding on Jobs
Service providers can make bids on available jobs, reviewing details, requirements, time scope, and budget if provided.
Providers can also message clients to request additional information if needed.
4.3. Acceptance of Offers and Commission
When both the client and service provider accept an offer on the Platform, they agree to specific terms and conditions.
The service provider agrees to owe Jobsey a 5% commission from the total job value once the project is accepted on the Platform. This commission will be deducted from the payment made by the client or invoiced directly to the service provider, as determined by Jobsey.
5. Fees and Payments
5.1. Commission
You agree to make payments directly to the Service provider as agreed between you and them.
Service providers are required to pay a commission of SCR 100 for jobs below SCR 2,000, and a 5% commission for jobs above SCR 2,000. Jobsey does not charge service seekers directly for job completion.
5.2. No Refunds on Commission
All commissions paid to Jobsey are non-refundable, regardless of any disputes or cancellations that may arise between the client and service provider after the job has been accepted on the Platform.
6. Disclaimers and Limitation of Liability
6.1. Platform as a Marketplace
Jobsey operates as a marketplace to connect users and does not guarantee the quality, suitability, or legality of any services provided or sought through the Platform.
6.2. No Endorsement
Jobsey does not endorse any specific service provider or client. Ratings and reviews are based on user-generated content, and while administration will monitor and may remove abusive reviews, Jobsey does not guarantee their accuracy.
6.3. Limitation of Liability
Jobsey is NOT legally liable for any disputes, damages, losses, or issues arising directly or indirectly between clients and service providers, including but not limited to, quality of work, pricing discrepancies, delays, or any other disagreement. All interactions and transactions between clients and service providers are solely at their own risk.
In case of a dispute between you and a service provider
6.4. “AS IS” Basis
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, either express or implied. Jobsey does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
7. Administration and Monitoring
All messages and transactions are logged for quality assurance.
Administration has full access to monitor all activity on the platform.
Users acknowledge that communications on the platform may be accessed by jobsey for moderation or in case of disputes.
8. Indemnification
You agree to indemnify, defend, and hold harmless Jobsey, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation of these Terms or your use of the Platform.
9.Cancellations and Dispute Resolution
Cancellations after job acceptance are solely managed between client and provider. Jobseyholds no liability for cancellations. Jobsey may assist informally in disputes by reviewing communication logs but is not obligated to intervene.
Any dispute arising from these Terms or your use of the Platform shall be governed by the laws of Seychelles.
10. Advertising
Jobsey reserves the right to display third-party advertisements on the platform.
Advertisers are responsible for the accuracy of their content.
Jobsey is not liable for any transaction or interaction with third-party advertisers.
